tl;dr version: You must look into Omaha and Sarpy County. Omaha is the home of Election Systems & Software voting machines. These are machines that have been used around the country, and they have a notorious record. Some models don't even use paper ballots. Furthermore, Republicans in neighboring Sarpy have been complaining for weeks that they weren't receiving applications and then they weren't receiving ballots. We have the news articles and we've reached out to some people named.

My lawyer is finalizing a quick draft as we speak. We have discovered major discrepancies and red flags in Nebraska's 2nd district. We were tipped off to this issue when the Republican representative and Republican local officials all won by ~20,000 votes, but not Donald Trump. According to the results as of right now, Trump is the only Republican candidate to lose the 2nd. Biden overperformed Obama's 2012 performance . How is this possible??

The main areas of concern are 1.) Omaha and 2.) Sarpy County. Sarpy County is the largest suburban county in the 2nd district. It is well-known to be the county that gave Romney and Trump an easy victory in the 2nd district after the state unicameral legislature redrew the lines in 2011. Several hundred people were complaining that they were not receiving ballot applications. We reached out to a few dozen people registered as Republicans and discovered that the state website says they didn't even attempt to vote by mail even though they claim they did.

We read an article 2 weeks ago (https://www.ketv.com/article/election-office-in-sarpy-county-now-looking-for-missing-ballots/24145410) that outlined this problem in Sarpy. We then quickly learned that Omaha is the home to Election Systems & Software. Even as recently as 2018, these machines were responsible for thousands of misplaced votes. Some of their models don't even print off a paper trail!

I WILL BE POSTING MY LAWYER'S FINDINGS TOMORROW. WE NEED THE STATE TO BLOCK CERTIFICIATION OR CONDUCT AN AUDIT. IF TRUMP WINS BACK THIS 1 ELECTORAL VOTE, HE JUST NEEDS PENNSYLVANIA AND EITHER MICHIGAN OR GEORGIA TO WIN. We are going to call and leave emails tomorrow; it REALLY sucks that we were so late doing this, but I only started doing research on this topic in the last 12 days.

I'm a physicist so my natural inclination is to dig into numbers. As of right now, the Associated Press is reporting that Joe Biden has received just a hair above 80 million votes, Donald Trump has received 74 million votes, Jo Jorgensen has received 1.86 million votes, Howie Hawkins has received 400,000 votes, and other candidates have received collectively 440,000 votes. The grand total of presidential ballots as of right now is 159 million votes. For reference, the 2016 election totaled ~136 million.

The turnout as of right now is between 67-69% depending on final tallies. For reference, the last time turnout was higher than this projection was 1900. In the last 100 years, the 1960 election between Nixon and JFK - which was notorious for exhibiting fraud - yielded the highest turnout so far at 62.8%.

I analyzed turnout in the last 100 years since 1920 was the first presidential race a majority of American men and women voted in. I only used presidential races.

  1. The average turnout in the last 100 years has been 55.3%. The turnout since the Civil Rights amendment has been 55.6%, and since the 26th amendment (which allowed under 21s to vote) the mean was reduced to 53.9%.

  2. The standard deviation since 1920 is +/- 4.10. In fact, since 1920, only 5 races have been greater than 1 standard deviation. Only 1 race has been greater than 2 standard deviations, and that was this year: 2020. In fact, 2020 is 3 standard deviations. No race has been 2-3 standard deviations below average, either.

  3. The voting-eligible population of the United States in Obama's 2008 victory was 230,000,000. The voting-eligible population this year is 239,000,000. That means, hypothetically, if Biden won 100% of all new voters within the eligibility range, he would still need to win an additional 1.5 million existing voters from 2008.

  4. In 2016, a maximum of 56% of new voters supported Hillary Clinton. In 2008, a maximum of 65% of new voters supported Barack Obama. According to the Brookings Institute, Biden received about 61% of new voters. Since there are 9 million new voters, the turnout was 67-69%, and Biden received 61% of this demographic, he could have gained between 3.7 million (minimum) or 3.8 million (maximum) from the new voter demographic. Notice how I'm intentionally assuming this turnout rate is reliable. In this situation, Biden received 7 million from voters who were eligible in 2008 than Obama did to make the AP numbers agree with the findings.

Georgia

  1. A federal appeals court on Oct. 2nd reinstated Georgia’s Election Day deadline for the receipt of mail-in ballots, staying a lower court ruling that had extended that deadline by three days for the general election. To request an absentee ballot, voters had complete an absentee ballot application and return the absentee ballot application to their county registration office. Some counties offer ballot delivery for registered voters who are hospitalized, and there are exceptions for overseas military personnel.

  2. Except in the case of a physically disabled voter residing in the county or municipality, no absentee ballot shall be mailed to an address other than the permanent mailing address of the elector as recorded on the elector’s voter registration record. Matt Braynard of the Voter Integrity Project found over 1,000 instances of people listing commercial properties like UPS in a single sample.

  3. A ballot must be received by the county registrar no later than the close of polls on Election Day. Ballots received after the polls close cannot be counted.

  4. It is the responsibility of the registrar to compare your absentee ballot oath envelope to your voter registration card to verify your signature, as well as compare your signature on the ballot envelope with your signature on the absentee application. We have no evidence that Fulton County and Cobb County upheld this requirement due to the disproportionately low rate of disqualifications.

  5. This is the biggest shock for me. Georgia allows private organizations and people to create their own ballot applications. "Any individual, organization or group may design their own form according to the requirements specified by Georgia Election Code." Furthermore, certain people are allowed to receive multiple ballots.

  6. A result of a primary or election may be contested on one or more of the following grounds: Misconduct, fraud, or irregularity by any primary or election official or officials sufficient to change or place in doubt the result; (...) When illegal votes have been received or legal votes rejected at the polls sufficient to change or place in doubt the result; (...) For any error in counting the votes or declaring the result of the primary or election, if such error would change the result;"

  7. For an audit to be considered legitimate, signature verification is a minimum requirement according to MIT and CalTech. "Auditors need to establish whether paper trail is trustworthy, through ballot accounting, checking against pollbooks and voter registration databases, reviewing chain of custody logs, video security surveillance, checking eligibility determinations, checking signature verification, etc." The initial recount only "audited" some of the machines and recounted ballots. The Secretary was not adhering the basic requirements of a risk-limiting audit.

Chief Judge David Smith, appointed by George Bush in 2002 and raised to chief in 2016. Most renown for investigating organized crime in the 1980s, but since his appointment most of his high-profile cases seem to focus on 1st amendment disputes. He's repeatedly reinforced that religious immunity comes before alleged civil rights violations. https://en.wikipedia.org/wiki/D._Brooks_Smith

Judge Peter Phipps, appointed by Donald Trump last year in July. He worked for the firm 'Jones Day' while it served as legal counsel for Trump's 2016 campaign. Extremely young for such a high-profile judge. https://en.wikipedia.org/wiki/Peter_J._Phipps

Judge David Porter, appointed by Donald Trump in 2018 right before the mid-terms. He attended the Scalia Law School and worked as an editor for its newspaper. Since 1996, he's been the President of the Pittsburg Federalist society. https://en.wikipedia.org/wiki/David_J.Porter(judge)

Stephanos Bibas, appointed by Donald Trump in November of 2017, was one of Trump's first judicial appointments. He is a noted scholar of criminal procedure with expertise in criminal charging, plea bargaining, and sentencing. He used to be a deacon for the 'Orthodox Church.' As a circuit judge in the 3rd, he's frequently been the minority opinion because of his support for the 2nd amendment against NJ regulations. https://en.wikipedia.org/wiki/Stephanos_Bibas

Thomas Hardiman, appointed by George W. Bush at the end of his second term. Hardiman was a finalist to succeed Antonin Scalia as an Associate Justice of the Supreme Court of the United States, alongside the eventual nominee, Neil Gorsuch. More conservative Republicans preferred his candidacy for Supreme Court over Brett Kavanaugh, but he is more moderate on immigration policy https://en.wikipedia.org/wiki/Thomas_Hardiman

Luis Felipe Restrepo, appointed by Barack Obama in 2016. The Senate voted 82-6 for Restrepo. President Trump nominated Restrepo to serve as Commissioner of the United States Sentencing Commission, a seven-member independent body that sets federal sentencing guidelines. It seems Restrepo is respected by both sides because he's more of a textualist on constitutional matters than most Obama-appointments. https://en.wikipedia.org/wiki/Luis_Felipe_Restrepo

Cheryl Ann Krause, appointed by Barack Obama in 2014. She's also relatively young at 52 years old. Krause has served as outside counsel for the City of Philadelphia's Board of Ethics and on the Board of Directors of the Committee of Seventy, a non-partisan civic organization focused on fair elections and government integrity, but she seems far more liberal than any other judge on this list - including Luis Restrepo. https://en.wikipedia.org/wiki/Cheryl_Ann_Krause

SEQUOIA VOTING SYSTEMS, INC. was co-founded in the late 1990s by three Venezuelan nationals. Their first projects were ATMs used in Mexico and Venezuela, but after the 2000 American election, they started to develop their Smartmatic vote counting software. Their big success came in 2004 when the opposition party's qualified for a referendum on Chavez. This is the year they received funding from the Venezuela government and were installed throughout the entire country. Chavez went on to win 60% for almost a decade until the 2010-2011 national election where he 'only' won 55%. I use the term win very loosely. The names of voters who had participated in the request of the 2004 recall referendum against Chávez had been made public and distributed amongst their military and police services.

Our very own United States Department of Commerce found out even in 2006 that the Venezuelans were contracting out their software while still owning propriety rights. Chicago was one of the first major American cities to use the machines. The software had 'malfunctioned' and stalled the results of the midterm federal elections for over a week. During the investigation, Jack Blaine, then-President of both Sequoia and Smartmatic Corporation, mentioned that Venezuelan investors still own a significant share - but he could not comment on whether Hugo Chavez was one of the investors.

In 2007, former Democratic president Jimmy Carter and James Baker, a Republican, issued a statement as co-chairs of the National Election Commission that warned such software is easily manipulated. I've provided sources explaining that this software and similar variants have been used all across South America including in Argentina and Brazil. A California investigation prompted by this statement found the following was possible:

1. Smartmatic “[A]llows the insertion of a Trojan program via a malicious USB removable storage media device that could modify ballot definitions and results. .

2. Smartmatic and related software “designed to conduct Logic and Accuracy testing in a mode distinct from Election Day mode, which enables malicious firmware . . . to avoid operating in an incorrect manner while in testing mode.

3. Such software contains “a shell-like scripting language in the firmware . . . that could be coerced into performing malicious actions, in apparent violation of 2002 Voting System Standards . . . [and that] includes, among others, a command to set the protective counter of the machine . . .; a command that can be used to overwrite . . . the system firmware or audit trail; and a command to reboot the machine at will.”

4. Permit “corrupted or malicious data injected into removable media . . . with potentially serious consequences including alteration of recorded votes, adding false results, and, under some conditions, causing damage to the election management system when the corrupted or malicious data is loaded for vote counting.”

According to trained specialists, Chavez and other corrupt officials learned that they didn't need to fake entire results like in previous decades of S. American politics. Chavez won his recall referendum by only ~800,000 votes. Distribute the fake votes across the entire country (in Venezuela, 23 states) and you only need to provide a paper trail for about 15-20,000 votes. The software stores the ballot template to count votes so it can easily be accessed by 3rd parties wanting to print ballots that look authentic. Furthermore, most states track registered voters and when they last voted. Experts claim that fake ballots are frequently made using identities of people the fraudsters know are unlikely to vote.

Robert Downes, a political counselor for Reason Magazine, said that companies using Smartmatic could be violating corruption laws. Well before Smartmatic, Venezuelan law had dictated that voting ought to be automated to limit fraud -- he U.S. company ES&S and Spanish firm Indra had already sold systems to the electoral body. When the new pro-Chavez CNE was named in September 2003, however, it immediately set out to replace all existing systems. Declaring the bid process to be an emergency (though there was as yet no referendum scheduled), the CNE bypassed normal procedures and initiated a closed bid process. Dominion is just another company in a long line that has followed this procedure to hide participants and investors from the regulators.

Hello.

I’ve compiled a list of legal cases that I believe pertain to the scandalous 2020 general election. I curated this list so that I could explain in a brief summary what the case entailed and wy I believe these cases are pertinent.

Bush v Gore (2000, 7-2 decision)

The per curiam opinion held 7-2 that the Florida Supreme Court's scheme for recounting ballots was unconstitutional based on the Equal Protection clause. The majority opined that even if the recount was fair in theory, it was unfair in practice. The record suggested that different standards were applied from ballot to ballot, precinct to precinct, and county to county. These concerns have only been amplified after several counties in Wisconsin, Michigan, Pennsylvania, Nevada, Arizona and Georgia treated the process far differently than other counties including 1) refusing to grant observers reasonable access, 2.) contacting voters to fix their ballots, 3.) altering the signature verification software to be more lenient, and 4.) granting privileged status to mail-in ballots.

Bush v Gore cited House resolution 1638 from 1886 where both the Democrats and Republicans jointly stated “"The two Houses are, by the Constitution, authorized to make the count of electoral votes. They can only count legal votes, and in doing so must determine, from the best evidence to be had, what are legal votes .... The power to determine rests with the two houses, and there is no other constitutional tribunal."

Colegrove v Green (1946, 4-3 decision)

The Court held that the Guarantee Clause in Article I, section IV of The Constitution left to the legislature of each state the authority to establish the time, place, and manner of holding elections for representatives. It also specified that the state legislature has the ultimate say in when an election has been properly certified.

Gray v. Sanders (1963, 8-1 decision)

The phrase ‘one man, one vote’ is commonly attributed to this case after Justice William O. Douglas wrote the majority opinion and said, "The concept of political equality...can mean only one thing—one person, one vote". Mail-in ballots suffer from an inability to decipher duplicates. Voters residing in different states have been caught mailing ballots to states they no longer reside in - Nevada and Arizona, notably. Furthermore, unsolicited ballots were sent out to addresses with little to no assurance that the votes being cast were legitimately from the correct person. Thousands of people reported that they received ballots for the former resident.

Dunn v. Blumstein (1971, 6-1 decision)

A Tennessee law required a one-year residence in the state and a three-month residence in the county as a precondition for voting. The Court held that the law was an unconstitutional infringement upon the right to vote and the right to travel. However, the entire bench agreed that states requiring 30-60 days to complete whatever administrative tasks are needed to prevent fraud is acceptable.

McPherson v Blacker (1892, unanimous decision)

The case concerned a law passed in Michigan which divided the state into separate congressional districts and awarded one of the state's electoral votes to the winner of each district. The justices all reached the same conclusion. Article 2 "convey[s] the broadest power of determination" and "leaves it to the legislature exclusively to define the method" of appointment. The case reinforced that the legislature has complete control over how electors are chosen and certified.

The Constitution specifies that if no candidate can secure 270 electoral votes in December, the House is obligated to determine the president. This has happened in the 19th century so there's both constitutional law and legal precedent.

You might think this is a disaster, but the Constitution doesn't require a simple majority in the House: it requires representatives to form caucuses by state. For example, Texas representatives would meet and vote amongst themselves. At the moment Republicans control 2 more states if this process were to occur before January, 1 state is tied, and 1 would be a potential tie because it has a former Republican turned Libertarian. Furthermore, we actually made grounds in the House so there is no hard deadline for our benefit. Stall tactics hurt Democrats even more.

Nancy Pelosi also can't play games with chamber rules. The Constitution specifies that for this process a quorum just entails 37 states having 1 representative present. Needless to say, that is really easy to accomplish.

Mississippi, Louisiana, Florida, South Carolina, Georgia: Tropical storm Zeta just hit Mexico and is expected to cause flooding. The best time to vote is either NOW or election day if you want to avoid the inevitable storms rolling in this week.

Midwest: Temperatures are expected to increase slightly around Halloween. If you plan to early vote early, Friday will have the least likelihood of rain and cold wind in states like Texas, Oklahoma, Colorado and Arkansas. Right now the average temperature in Texas is in the 40s-50s but it's expected to rise to 60s-70s.

Pennsylvania, New Jersey: Black Lives Matter and Antifa are at it once again with riots after Walter Wallace was shot for charging officers with a knife in his hand. Riots almost always get worse during the weekends or during major holidays so if you live close to Philadelphia, consider voting on Thursday instead of Friday.

California: Vote as soon as you can if you live anywhere near an active wildfire. My advice would be not to wait unless you're confident the fires don't pose a risk. You don't want to worry about voting in such circumstances.

Northwest: Rain is expected in the middle of the week and the latter half of the weekend, but temperatures appear to remain relatively stable.

**URBAN VOTERS: My advice would be NOT to wait until election night. Urban counties and especially cities are notoriously bad at managing lines. Some states are also worried about violence erupting on election day so you might want to ensure your safety by voting early this week. This isn't really a concern suburban and rural voters need to worry about, but I had to mention it.

We need every Republican, independent, disgruntled Democrat and disgruntled libertarian we can. They're cheating. They're changing the rules. They're getting help from Iran and China. Trump Derangement is off the charts.

It's better to vote than to not vote. A storm is approaching Florida at the end of this week. Snow is coming to some northern states

Also get more Trump voters!

This year out of 100 political poll calls, only about 8 people answer & complete the surveys. Bias due to non response is calculated by:

BIAS = RESPONSE RATE *(ACTUAL RESPONSE- REPORTED RESPONSE)

Twice as many voters who support Trump say they keep their support to themselves than Biden supporters. Assuming Republicans who inevitably respond are still nonetheless Trump supporters, this affects Independents the most. Right now about a third of all voters identify as Independent so I did a back of the envelope calculation:

.92(66-43)/3. This equals 7.1%.

This means Trump could potentially have 6-8 points more support in the national polls than projected. In other elections the number of Americans shy about their support has never been 2:1 so normally this process is washed out. Republicans usually outperform expectations by 2% because conservatives are less reluctant to even admit their politics

6,000 mail in ballots have already been rejected in North Carolina - 40% black voters. Over 14,000 in Florida although Florida allows people to fix it if there's enough time.

These numbers do not reflect ballots lost in the mail which is usually 0.78% according to the Post Office.

If you HAVE TO VOTE by mail, do not let your vote have any excuse to be rejected. You are still rolling dice compared to in person voting but do not end up a statistic

If there's a 3rd debate, the moderator & Biden are going to use this excuse. There's 2 responses Trump needs to offer.

  1. Are you saying the photos of your son are fake? The photos of him with a meth pipe were taken from the computer. Are the sources lying?

  2. The FBI has allegedly possessed these files and emails since before the fake impeachment effort & they still can't find Russian connections.
