Without it, they stand to shrink as an industry, lose funding for their ever-increasing prison population, and they would have to focus on other things that are harder to prosecute, which they don't want to do. It was borne from frankly racist (and not the left's definition of racism but actual racism) laws to imprison a large part of the "free" minority population after the Civil War and during Reconstruction, and vastly expanded during the War on Drugs in the 80s and went into overdrive after Biden's crime bill in the 90s.
