That is a good point. However, defrauding the senate by making unconstitutional rules changes for the purpose of bypassing the senate leaders authority and knowingly certifying election fraud is a bit more treasonous than some of the other laws they have violated.

Correct. But because of a recent senate rule change made by the parliamentarian body, I do not know who exactly had the constitutional authority to legally ignore the electors.

Because of some tricky wording in the rule changes, Pence may have been unconstitutionally stripped of his authority to make the decision (according to new senate rules).

It appears that the parliamentarian body decided to give itself authority to decide whether to ignore electors or not, before Pence even got the opportunity to rule on it. Hence his odd statement about his accepting the electors being "ceremonial." Maybe he really is telling the truth!

That copy of the law you posted is outdated. The senate just recently changed the law to include the parliamentarian "middleman" scenario I described above.

But the parliamentarians inserted themselves into the process as a sort of middleman, granting themselves the authority to deny rival electors. At least that's what appears happened from what I can tell.

I don't see how that is not a constitutional issue, seeing as it is a federal body inserting itself into the selection of state electors without specific constitutional power to do so.

This is what I've been trying to figure out. There is another post that claims (and provides evidence) that the senate rules were recently changed to basically strip Pence from being able to decide alone on the issue.

I am wondering how in the hell that isn't a constitutional violation that needs immediate attention by the supreme court. Seems like federal authority interfering in state election matters without constitutional authority to do so.

I am not aware of any constitutional power that grants senate parliamentarians any legal authority to dictate the constitutional authority of the senate leader for making determinations that affect state election law.
