Any destoryed evidence shifts the burden of proof to defendants. If the evidence that's been alleged to have been destoryed isn't given to the court by the defendants the allegations made by plaintiffs are considered true.

Destroyed evidence counts against you in court cases. If you destroy evidence it's assumed to be in favor of the plaintiffs (you'd have no reason to destroy it if it was in your favor).
And don't forget it'll have to go to the supreme court.
