Accidents that are found to be 50-50 don't go against anyones insurance. At least there's that. Did you ask your insurance about rental though? If not I think it would be worth it. Even minimal insurance covers rental, at least in any state I've ever registered a vehicle.
Do you and the other party involved not have insurance? In 100% of cases that I am aware of the person who is at fault's insurance covers rental expenses for all involved parties. Usually you get the approval through your own insurance and they get reimbursed by the at fault party's insurance. Good luck, hope everyone is OK.
