Couldn’t be from the vaccine. It didn’t happen during the 15 minute post injection reaction waiting period. Nor can it be reported as clot shot related because she is unvaccinated. Was past 14 days after her second shot. So sad.

Good Morning sir or ma’am,

I understand that there is a mandate in place, however the implementation appears to have been moving faster that a full review of the actual situation that exists.

I have come across contradictions that do not appear to take into account current laws in regard to the use of investigational new drugs i.e. EUA authorized Pfizer BioNtech COVID-19 vaccine. Without a Presidential Executive Order that targets a specific operational population of service members an EUA product cannot be mandated for use by the service members.

The products in question may be chemically the same and interchangeable medically, however, they are legally distinct. They are legally distinct by way that as an EUA authorized product the Pfizer BioNtech COVID-19 vaccine is protected from all liability, requires informed consent and can be denied without repercussions per 21 U.S.C 355 (i)(4).

There is no approval of interchangeability in the Biological License Application (BLA) approval for Comirnaty. It is only authorized under the EUA authorization as shown below. This means that the interchangeability is reserved for use within the EUA authorization and not under the BLA approval.

The FDA repeatedly addresses the legal distinction and the EUA status of the Pfizer BioNTech COVID-19 Vaccine throughout the Pfizer-BioNTech COVID-19 Vaccine EUA LOA Reissued Aug 23. I have provided below each excerpt in regards to this and highlighted the relevant sections of the attached PfizerBioNTech COVID-19 Vaccine EUA LOA Reissued Aug 23 letter.

Again, Pfizer and the FDA address these themselves by the release of a ‘Dear Health Care Provider’ Letter (Dear HCP) that identifies specific lots produced in accordance with all requirements to meet designation as Comirnaty despite retaining the Pfizer BioNtech COVID-19 Vaccine EUA labeling. All other lots of Pfizer BioNtech COVID-19 Vaccine retain the legal status and requirements of an EUA product. Also attached and annotated below.

The Dear HPC lots are: FD7220, FE3592, FF2587, FF2588, FF2590, FF2593, FF8841.

Individuals are being intimidated, bullied, threatened and mislead into taking an EUA product across all branches. Individuals are being told they cannot submit religious exemptions because they have gotten vaccines before. They are being told they cannot submit religious exemptions because the Pope has said the vaccine is ok. People are being told not to bother because the CO will deny it, that Christians are not allowed to submit exemptions or that the deadline has already expired, too bad. Threatened with NJP and court martial if they don’t line up and accept the shot today. These are anecdotal and I do not have permission nor the knowledge to provide names associated with these above-mentioned events. Many of the stories I have been hearing for the past two weeks fear retribution and punishment above the existing harassment and intimidation they are currently receiving.

There is fear and anxiety around this product and the lack of transparency that the services are perpetuating. This is greatly exasperated by the lack of implementation guidance, knowledge of the exemption process by both the individuals and the commands and the complete disregard of the individual service members concerns.

We all know that orders can be made more restrictive by subordinate commands such as the establishment of a timeline not explicit in the SECDEF Memo. However, what we are seeing is an expansion of the order by the inclusion for the EUA product despite the SECDEF Memo specifically stating ‘Mandatory vaccination against COVID-19 will only use COVID-19 Vaccines that receive full licensure from the Food and Drug Admin, in accordance with FDA-approved labeling and guidance.

I understand that I am a layman and I may be off base here but if I am not the Corps is positioning itself for a legal issue by failing to provide informed consent and what that implies. Religious discrimination and human rights violations. This is also putting the health care providers physically injecting the EUA vaccine at risk of violating the laws governing administration of an EUA vaccine.

Honestly with all respect. I just feel that too many people are being ignored, disrespected and denigrated.

Pfizer-BioNTech COVID-19 Vaccine EUA LOA Reissued Aug 23 Specific legal distinction defining that Comirnaty (COVID-19 Vaccine, mRNA) is FDA approved with a BLA License and that Pfizer-BioNTech COVID-19 Vaccine is continuing exclusively under EUA authorization identified by the FDA Comirnaty (COVID-19 Vaccine, mRNA) (yellow highlight on the document).

            Page 2 third paragraph: Pfizer-BioNTech COVID-19 Vaccine contains a nucleoside-modified messenger RNA (modRNA) encoding the viral spike (S) glycoprotein of SARS-CoV-2 formulated in lipid particles. COMIRNATY (COVID-19 Vaccine, mRNA) is the same formulation as the Pfizer- BioNTech COVID-19 Vaccine and can be used interchangeably with the Pfizer-BioNTech COVID-19 Vaccine to provide the COVID-19 vaccination series. 

Footnote 8: The licensed vaccine has the same formulation as the EUA-authorized vaccine and the products can be used interchangeably to provide the vaccination series without presenting any safety or effectiveness concerns. The products are legally distinct with certain differences that do not impact safety or effectiveness.

I.C: Criteria for Issuance of an Emergency Use Authorization requires that there is no adequate, approved, and available alternative to the emergency use of Pfizer-BioNTech COVID-19 Vaccine to prevent COVID-19.

Footnote 9: Although COMIRNATY (COVID-19 Vaccine, mRNA) is approved to prevent COVID-19 in individuals 16 years of age and older, there is not sufficient approved vaccine available for distribution to this population in its entirety at the time of reissuance of this EUA.

Product Description page 7 third paragraph: The Pfizer-BioNTech COVID- 19 Vaccine vial label and carton labels are clearly marked for “Emergency Use Authorization.”

            Product Description page 7 last paragraph: The emergency use of PfizerBioNTech COVID-19 Vaccine under this EUA must be consistent with, and may not exceed, the terms of the Authorization, including the Scope of Authorization (Section II) and the Conditions of Authorization (Section III).

II.Y: This product has not been approved or licensed by FDA, but has been authorized for emergency use by FDA, under an EUA to prevent Coronavirus Disease 2019 (COVID-19) for use in individuals 12 years of age and older; and

III.AA: COMIRNATY (COVID-19 Vaccine, mRNA) is now licensed for individuals 16 years of age and older. There remains, however, a significant amount of Pfizer- BioNTech COVID-19 vaccine that was manufactured and labeled in accordance with this emergency use authorization. This authorization thus remains in place with respect to that product for the previously-authorized indication and uses[…]

III.BB: A through W in this letter apply when COMIRNATY (COVID-19 Vaccine, mRNA) is provided for the uses described in this subsection III.BB, except that product manufactured and labeled in accordance with the approved BLA is deemed to satisfy the manufacturing, labeling, and distribution requirements of this authorization.

Dear Health Care Provider Letter:

Many lots of Pfizer-BioNTech COVID-19 Vaccine are in circulation that were authorized for emergency use, and are labelled in accordance with the EUA. Some of these lots comply with the recently approved BLA for COMIRNATY and are therefore considered “BLA-approved” lots for administration to individuals 16 years of age and older.

Please note, it is imperative that you not discard any available EUA lots. These lots continue to be authorized for use under EUA in individuals 12 years of age and older, and for use as a third dose in certain immunocompromised individuals.
