My understanding is the Judge did not permit the evidentiary hearing, then dismissed with prejudice. I not an attorney, but it would seem to me that it is the admittance of the evidence itself is what the appeal will be premised?
AND once SCOTUS rules, it sets legal precedence, meaning all other cases brought on similar grounds will be ruled by lower courts exactly the same way. Game. Set, Match.

Ahem. There are only 3243 counties. There area number of ways of hiding ballot identities.Some more sophisticated than others. But many ways. If Acme county is shipped 22,000 ballots, and prior to delivery, those ballots are replaced with coded ballots, then one has established a method of accounting. So if Acme ballots end up in Baker county then fraud has been established. There are only a few states that you need to run the sting operation in...and in those states, only selected counties. Very do-able. As for the block chain, sure, why not? Perhaps it can be leveraged for real time re-counts the public can view.
