The FBI are not American any longer they are wholly owned by the Democrats who themselves are owned wholly by the Chinese. FBI are hostile foreign agents and all need to be put up against the wall when the reckoning comes.
I don't want to see beatings, I want to see executions.
The piece of shit has made the world a better place by dying. Probably the only useful thing he has ever done.
kill them and their familes
yes it is. https://www.ellenpage.org/html/contact.php
Yup, we are going to need wholesale executions.
Yes, and the manner in which the electors are selected, as the legislature directed, was outlined in the Pennsylvania Election Code. To use your logic if, god forbid, Democrats won the Senate and (hopefully) Trump is re-elected would that mean that his entire cabinet could be dismissed at a whim because they no longer have the consent of the Senate?
Trump should give the corpse of RBG the Presidential Medal of Freedom. Why? If RBG had not died freedom would have been lost.
Looking at this the using the UCMJ to try criminals is with respect to armed conflict involving Civilian Americans collaborating with the enemy in a conflict zone. Not sure if it would apply.
never understood that
Not sure on the LARP but Trump is not exactly the type of guy who would want to go to a place like Camp David. The President is not exactly and outdoorsy guy unless it is on a golf range. Guy is a billionaire and enjoys the finer things. Makes me wonder why he is headed there in November of all months. I think that it is in order to ensure a secure location close to Washington DC.
To be fair Hillary did fight a number of legal battles.
That is a simplistic and naive look at it. You are correct the doctrine of Federal Supremacy causes Federal laws to override any and all state laws/constitutions let alone the U.S. Constitution itself which is the supreme law of the land. The Constitution however was very cognizant of the need for checks and balances so it gave the states (through their legislatures) the ability to decide how to appoint it's electors and conduct it's elections. This is why the United States has a decentralized elections system. The State of Pennsylvania legislature passed a statute called the Pennsylvania Election Code that delegated the certification of the vote to The Secretary of State for Pennsylvania (which is legal). Since this is a state the state legislature would need to repeal/amend that section of the Pennsylvania Election Code and a repeal is a bill and a bill needs the governors signature or a successful override vote in order to become law.
The problem with that though is does that not mean that the legislature could then repeal any and all legislation it passes into law ( the act of repealing is in of itself a bill) without the Governor;'s signature?
The problem with that is that the delegation was done via a statute. A statute can only be removed with a repeal which itself must be signed by the governor or overridden in the house. Seeing has how the Republicans only have 113/203 house seats and they need 135 votes to override I see either of them as unlikely outcomes.
It's frustrating because that is not how the law works.
The United States Constitution gives the power to the legislature yes but through state law the power to certify the vote was given to the State executive. Since this is the case the law itself would have to be repealed which in of itself would require the governors signature OR enough voted (135) to override a veto from the governor. The state legislature currently has 113/203 seats meaning that EVERY Republican would have to sign off AND 22 Democrats would have to vote in favor of an override. Seeing as how the Governor is a Democrat I do not see either of these things happening.
Now the U.S. Constitution grants these rights to the states to select the electors how they will. The Pennsylvania State Constitution does NOT give the power to the Secretary of State of Pennsylvania but Pennsylvania Election Code (a state statute) does. There has been some talk about the legal concept of Delegata potestas non potest delegari being applied. This is a principle in constitutional and administrative law that means in Latin that "no delegated powers can be further delegated." and that as a result the statute or at least portion of Pennsylvania Election Code is in effect "ultra vires" or "beyond the powers" meaning that the state legislature exceeded it's authority in delegating these powers to the Secretary of State of Pennsylvania and that the statute or at least this portion of the statute has no force of law. The problem with this argument however is that this legal concept (which is well established in U.S. common law) is with respect to delegated powers. So for example if the statute delegated the power to certify to the Secretary of State of Pennsylvania, that person in turn cannot delegate the power to another. The issue occurs because the U.S. Constitution gave the state legislatures the power and through the Pennsylvania Election Code this power was only delegated once to the Secretary of State of Pennsylvania, which is both legal and constitutional.
The only remedy to this would be if a court somehow determines that the law itself was ultra vires meaning the part of the statute delegating certification has no force of law (and thus it reverts to the legislature). This could very well be the case. I am not a lawyer but I do have a very good working knowledge of the law. I know enough to navigate constitutions and statutes as well as legal remedies but I do not delve into the arcane world of case precedent. If there is an actual legal pede that can provide other avenues I would really like to know if there is something I missed.
The only Dutch I have respect for is Ronald Reagan (Dutch was his nickname).
They are senate anyways we are talking the house.
Hang? No that is far too generous. We need to bring back torture/rape as a punishment and have them subjected to it for months, if not years, on end.
Won't happen. I thought to do this last time and she had it so it was Emoji chat only. Could still be possible if pedes can get creative with the emogi's.
Skip the arrest and execute him.
We need patriots to guard them
The only way to take back our Republic at this point is a civil war be a hot or cold. the FBI is our enemy .The highest echelons of this corrupt institution tried to overturn a duly elected president. When that highest tier was expunged they were replaced by the next level or rot. The FBI is like a gangrenous limb, it needs to be removed and destroyed, just like the CIA. We need whole sale executions of every level of management of these corrupt institutions, scatter them to the wind, then create new institutions with the same mandate only staffed by patriots.
Thomas Jefferson said that every so often the tree of Liberty must be watered with the blood of traitors and patriots. The tree is very thirsty right now.
