McConnell prevented Obama's selection of Merrick Garland (for Scalia's seat) from even being brought up for nomination on the basis of the "Biden Rule"... which was simply based on Joe Biden's 1992 senate speech in which he argued that if a Supreme Court seat was to be vacated close to the election (in the spring/summer of 1992) then GHW Bush should NOT put up a nominee and instead let the election decide the fate of this seat... Biden was essentially reading the tea leaves... knowing that Bush was NOT going to win the election (obvious with the Perot split) and setting up the political backdrop for preventing any late administration court nominations.

The “Biden Rule” is not an actual rule but a political maneuver that attempts to build public consensus for a concept of how a president should rightly function when nominating justices (of course with Biden’s preferred outcome). So, with RBG probably bowing out in the next 3-6 months it would put McConnell right in the same position as Biden thought he might be in the summer of 1992 and, more importantly, in the exact same position he already found himself in in 2016.

How could McConnell argue BOTH points... that in 2016 it was right to invoke the "Biden Rule" and NOT allow Garland but now in 2020 to allow the replacement for RBG?

My suggestion for a workable political basis for McConnell to violate the “Biden Rule” is that IF there is an active, totally partisan impeachment sham happening, all bets are off... Not to mention the fact that the Democrats are likely trying to impeach Trump SPECIFICALLY to prevent him from successfully nominating a successor to RBG.
