Legislature appoints electors. We have dueling electors in the capital, one set appointed by Secretaries of States and one by Legislature, on December 14. We have the House select one group and the Senate select the other. They fight it out in the courts until SCOTUS says disqualify all dueling electors and we have the House vote according to the 12th amendment. Trump won more states so likely Trump 2020.

My question is how will the House decide which votes to honor if a state sends 2 sets of electors? It's a democrat house so can they just decide, hey, we'll just accept the electors sent by the Secretary of State from PA instead of the electors sent from the legislative branch? It seems like a potential SCOTUS case or at least PA Supreme Court case to me.

Look, I was saying there was legal merit to his opinion. Just because he rules against the 1st amendment does not make an issue not moot. The court is not entitled to rule on issues which are moot. Unless there is substantial risk of harm in the future, which in this case there was (see Gorsuch concurrence). The government is allowed to limit free speech in certain instances which do not completely foreclose the possibility of speech, the freedom of speech is not absolute. In this case strict scrutiny was the appropriate standard because speech was foreclosed to groups of people. However, by changing the color to yellow instead of orange or red the issue of foreclosure of speech was not a problem and the issue was moot. However, because the government had the authority to change their mind arbitrarily at any time the majority and concurrences were more appropriate and Robert's dissent was incorrect imo.

Honestly, I see the merit in Robert's opinion. The problem technically is moot. However, Kavanaugh and Gorsuch make good counterpoints that the governor can change his mind at any moment to change colors so injunctive relief is necessary.

There's no such thing as journalism anymore because there is no respect for fact any more. All the news now adays is just OP-Eds and opinion pieces about current events. Unless something happens in the future the media will just continue to further bastardize our great freedom of the press. Journalism, not God, is dead. Our formerly glorious institutions have been infiltrated by those who think patriotism is a four letter word. I'm disgusted by the state of our society. Kill all the congressmen and disassemble the adminstrative state!

Every press conference it's "why don't you concede Mr. President?" They know why. He has active litigation which could change the course of the election and throw out ballots. Most states haven't even certified and all the states haven't had their electors vote yet. The president has not determined yet. They are trying to bully him into it lol good luck, he's put up with their bullshit for four years already he knows how to deal with it.

unfortunately, courts of appeal cannot consider new evidence in a case before it. They have access to the record on appeal, which is every filing prior to the appeal. Any new evidence will need to be considered on remand to the district court once a court inevitably finds Trump has standing.
