Biden will have enough votes unless they are challenged. Those challenges do not trigger 12A until challenges succeed. We will not win a single challenge because we don't have a majority in either chamber. Therefore, there's no way to trigger 12A.
Not during the objections. That's a simple majority and we don't have it in either chamber. This is not a winning path.
We can run out the clock with procedure, though. But that will give us President Pelosi and Trump is locked out entirely from the process or decision.
We will lose the votes to challenge. We don't have them in the House nor the Senate. Pence can only choose to count votes if 12A is triggered, which is simply not going to happen.
