That was argued in court today. I don't think the state official would be able to get away with it at SCOTUS. But all of them agreed there is no SCOTUS precedent. That's more reason for the judge to dismiss it to send it to SCOTUS.
Probably not. Judges like specific evidence, not circumstantial evidence. As a lower court judge, specific evidence is even more important. And he knows that this belongs at SCOTUS anyhow. I believe he'll dismiss the case so they can appeal it quickly.

The one thing where she's correct is it takes 3/5 majority of legislature to meet. That's not going to happen.
Same with Arizona.
The only way this will can be fixed is in the Court. The hearings are great show, though.
