If the police did not do anything, but the suspect has a gun and shoots an officer - People will say he is stupid for not following proper police procedure
If the police attempts to talk - The individual already does not show sign of abiding by the rules, so this will likely not work
Had the police shot the legs instead - People will still call police brutality
If the individual was guilty of something and decided to resist - Probably not going out without a violent confrontation
