Public domain is if someone can reuse, modify, and otherwise use for any reason (including resale) without attribution and without permission. (Please note: I am not a lawyer, this is not legal advice, don't sue me.)
Open source is if the source code is available, but it does not necessarily need to be made available in the public domain. For instance, I license all of my "good" stuff under the GPL 3. It's still open source, but not in the public domain. TD.Win's source code AFAIK is not open source (wink please?).
Also, there needs to be an easy way to hash check a specific machine against the publicly screened version.
Yes, but it is quite impossible to do this well; for instance, how does one ensure that the program that is checking the hash is not lying or is maliciously programmed to just spit out the hash of the open-sourced version? (I don't know either.)
They don't need to be public domain. Open source is fine.
