  1. 1789: George Washington: initially established much of the judiciary, lower courts and established 6 justices, of which 5 would randomly hear and decide a case.

  2. 1801/1802: Reorganized the lower courts -- This was known as John Adams' Midnight Appointments. 5 justices (1 CJ + 4 Assoc.) Repealed under Jefferson and restored back to the 1789 Act.

  3. 1866: Post Civil War under Andrew Johnson -- 7 justices, It said the POTUS couldn't make an appointment until number declined to 5, at which point he could appoint 2 more, and a quorum would be 5/7 justices.

  • Johnson begrudgingly signed this; it meant he tied his hands on SCOTUS appointments. He signed because Congress was veto-proof Republican at the time [they had 70% in both Houses] and his veto basically didn't mean jack shit. Congress overrode his veto on basically everything and Johnson and Congress hated each other at the time.
  • It was done since there were vacancies at the time, and Congress didn't want Johnson to appoint CSA loyal justices to the court.
  1. 1869: Ulysses Grant -- sets the number to 9; is the most recent time number has been changed.

  2. Various Judiciary Acts have been enacted since then, either changing the lower courts, their composition, salary of the SCOTUS, etc. But none since 1869 have changed the number of the SCOTUS.

So the number has changed from 6 to 5 to 6 to 7 to 9 where it is currently - Article III enables Congress to change the number of the SCOTUS at any time.

I don't know why Trump didn't stress this more. He didn't really understand how to use the "never let a crisis go to waste" philosophy to advance a right wing agenda.

The minute they started screeching about Covid, he should have shut all the borders and zeroed out immigration, and just hammered Biden on that. It would take away the taking point of cOvId.

He also could've shut down all BLM rioting with his Stafford Act powers - the POTUS has the ability to quarantine all individuals suspected of being infected of a disease using civilian or military forces. It was the perfect excuse to shut down BLM - use COVID and quarantine all of them.

My point is that it does not require a Constitutional amendment to do this. It was changed like 5 times in 80 years since the founding of the country by an act of Congress.

Now...this bill is still DOA in the Senate since you need 10 Republicans for this to pass in the Senate.

Manchin and Sinema are a no on nuking the filibuster. So as of right now, this bill is DOA in the Senate since you need 10 Republicans to vote on it to become a reality.

This. The number of justices can be changed by an act of congress and has been done 4 or 5 times in history.

Same thing with the number + structure of lower courts. Congress can change that by a simple act.

Congress can also by legislation strip the lower courts of jurisdiction on certain matters.

Yeah...this is one of the things Scalia warned. A Convention could not be limited by Congress or by the several States to any one topic. You need 2/3 to apply for one, and 3/4 to ratify any amendments.

So theoretically they could apply for a convention to pass a Supreme Court justice cap amendment, but the actual Convention doesn't have to be limited to that...it could do anything such as repeal the whole bill of rights or dissolve the United States entirely or make the president a totalitarian dictator.

A COS would have so much power it's downright dangerous.

The number of Seats were changed through an act of Congress numerous times...it went from 5 to 7 to 9 to 7 to 9. Congress actually reduced the number at one point to prevent Andrew Johnson who was on his way out the door from naming any new appointments. The most recent time it was changed (increased to 9) was in 1869, under Ulysses Grant.

It requires an act of Congress, not necessarliy an amendment.

He's not actually gonna do it - besides, he doesn't have the votes. For this bill to pass the Senate, you need 60% because of the filibuster. And Schumer doesn't have the votes to nuke the filibuster (Manchin & Sinema are a no).

This is red meat for the base to try to get people off their couches in 2022. Remember when 0bama had the House, Filibuster Proof Senate, and WH in 2009-10 but since few Dems showed up to vote in the Midterms, GOP won it in a blowout? They're trying to get some incentive for their base to show up. They don't have the votes to pass it.

It allowed a student who didn’t use anabolic steroids to sue the school and the user of the steroid if it was later found out someone on the team was using them.

It was styled similarly to the Idaho bill which is getting shot down in the 9th Circuit as we speak.
