The insurgence act signing itself won't be made public and I would only expect a few mil-ops to know about that. He does have to warn the insurgent to "disperse." Now, he did tell everyone to "go home," but meh, that's not a really good argument. He would also need to find a secure location and there would be abnormally high amount of air traffic. The solution for a 10 day, full forensic, signature matching, audit of the contested states is all that was needed. If they find enough massive fraud to overturn the election, great. If they don't find enough fraud, then that's great too. I'm willing to live with that. Not only that, but it would calm everyone down. The fact that they didn't even try to do this leads me to the conclusion that it's a coup.

The Jefferson argument by Dundas isn't really the same thing. I'm not saying Pence doesn't have the power, but rather, I agree with Legiapede that it's a grey area. In history, there are cases for both where the VP made a decision (even against the rest of Congress) and other times Congress would weigh in and make the call. Confusing right? So in 1887, they came up with the Electoral Count Act (ECA) to clear things up, but that made it even more painfully confusing. No one really knows for certain what will happen on Jan 6. The only thing I can say is that it will be interesting (wild, some would say) since this election is very unique.
What will help is proof, which is what the Trump team has been working on. If a state says, here's the proof, here's the evidence on why it should be de-certified and in some cases, it's pretty obvious that a state ran an unconstitutional election, then that gives more power to Pence to de-certify that state.
But Party A doesn't even need any electors (It's nice to have for formality reasons). At the end of the VP count/vote on Jan 6, you can have 269 electors for Party B and the rest of the electors were "not counted" by the VP. To win the presidency, you don't need more electors than the other party to win, but rather, you need the other party to not reach 270, so another process can take place. Party A can literally have zero electors. This then becomes a contingent election (no one got 270), House votes with 26 Party A votes, Party A POTUS wins.
Something doesn't make sense about the law. If the VP has that much power (opening or picking which states he deems legit), can't his party practically hold the presidency forever as long as 26 of the state House are in his party? So let's say VP is in Party A, they lose all 50 states in the presidential election, but the House in 26 of those states belong to Party A, then the VP can just reject all 50 states (or even until the other party doesn't reach 270) and the POTUS for party A wins.
At that point, why even have presidential elections when the outcome is actually determined by the House and the sitting VP?
Agreed. Trump isn't an ideologue. He's a clever pragmatist. If you want an ideologue, you voted for the wrong POTUS. Of course it's a horrible pork bill. But instead of standing in the corner pouting with ideals, Trump is actually trying to change things for the better with what he is given. The problem are the republicans that made it a super majority. The swamp was bigger than we thought.
