Hello pedes, I'm a constitutional law professor in one of the universities here. I'm a closet DJT supporter because my whole family, including my wife is liberal. The reason being I was just redpilled a few years ago.

I voted for DJT last November, and I strongly believe he should be president for life. However, I would like to correct the misinformation being peddled in here. I'm not a doomer, you can call me one if you want to, but here are the facts:

1. Pence has no unilateral power to reject a state's certified electors.

People keep bringing up the 1800 election when Jefferson supposedly decided to count electors for himself. This is partially true. However, what happened was the Georgia electors' papers were somewhat defective and Jefferson somehow decided to count them. There were no objections.

The 12th amendment also does not say anything about the Senate President having the power to "reject" or "accept" electors. The language of the law is clear in giving the Senate President only ministerial powers.

2. There are no competing slates of electors (yet).

No states have officially sent 2 slates of electors. The electors must be sanctioned by a state body, either the whole legislature or the executive to be deemed "official". In the Nixon and Kennedy election, both slates of electors had the governor's certification due to the result of the recount.

The only way for there to be competing slates is for state legislatures officially voting and sending an official list. This has not happened.

3. Even if there are competing slates, a Democratic House will not accept Trump electors. There is also doubt that the Senate, with RINOS like Romney and Collins will side with Trump.

The Electoral Count Act (which some argue may be unconstitutional) will be followed by Congress in resolving disputed electors. The 12th amendment has no procedure for dealing with dueling electors.

Both Houses will also make a joint resolution for the procedure of the counting in Jan. 6th. It will have the Electoral Count Act as the dispute-resolution process, as it has been for many elections before.

4. There is little chance for a state delegation vote.

The only way to trigger a state delegation vote in the House is to have a contingent election. This means that no candidate has reached 270 votes after the counting has finished. In the meantime, if there is a deadlock, say hello to President Pelosi until the deadlock is resolved.

I hoped that DJT will win. But, there is no realistic legal path for DJT to be president. Biden will take his oath on the 20th. May God bless us all.
