With regards to Pence’s authority, there is nothing in the Constitution that mentions certification by the state legislature or executive branch. The only “certification” done is by the electors themselves, which are chosen in a Manner as determined by the legislatures of each state. Pence needs to decide if the legal votes are what determines electors or the ones certified by the Governors. If I’m in Pence’s seat and assuming he has Wisdom and Courage, I would view the count at midnight on Nov 3rd in GA, PA, MI, and WI as the way to determine the legal votes and open and count the Trump electors. Then it goes to the above situation.
My point in all of this is that after the electors for Trump got seated and voted on the 14th they can be received by Pence without further procedure form the courts and legislatures.
Based on the text, his powers are to open the certificates and count the votes. The vagueness allows for wide interpretation. Such interpretation would be left to him, but the SC or Congressional majority could also weigh in after Pence takes action.
Pence can choose which slate of electors' certificates to open. He would need arguments for his decision, and that's why I think PA, MI, GA, and WI are the states that he should take the Trump electors from because at midnight on November 3rd Trump was ahead in those states by significant margins and the number of contested votes is multiples larger than the Biden margin post-Nov 3rd. It would be a pretty clean decision in my opinion. By not accepting Trump's electors in the other states where Biden was ahead on election day (i.e. AZ, Nevada), Pence would seem more selective and consistent in his decision.
Of course, there is still time to overturn the results of some of the states, making it even easier for Pence.
The text of the Constitution says that it's the electors who sign, certify and send.
"The Electors shall meet in their respective States, and vote by Ballot for two Persons, of whom one at least shall not be an Inhabitant of the same State with themselves. And they shall make a List of all the Persons voted for, and of the Number of Votes for each; which List they shall sign and certify, and transmit sealed to the Seat of the Government of the United States, directed to the President of the Senate."
Sure. Nothing in the Constitution mentions that only governor certified electors can be accepted. The only mention of certification is BY the electors, which are chosen in a "Manner" decided by the state legislatures. State legislatures have written the laws as to who votes and how; they may have also made into law that the Governor certifies the electors. However, Trump's electors counted legally cast votes and if they sign and certify their vote, then Pence can accept those if he has the Wisdom and Courage and believes the multiple findings consolidated nicely in the Navarro Report.
I would argue that the laws regarding who gets to vote and how are of primary significance and supersede the authority of the governors. In this case, there is nothing in the Constitution that says that the President of the Senate, when presented with two slate of electors that have complied with the "Manner" chosen by the state legislatures in some form (Trump's are compliant with the laws of who can vote and how; Biden's are compliant with Governor certification), cannot make a judgment call as to which to choose. It will depend on Pence to have the Wisdom and Courage to choose the Trump electors.
