If you're referring to impeachment 2.0 I doubt that it is. The speech or debate clause in the Constitution (Article I, Section 6, Clause 1) gives members immunity from many acts which would otherwise be grounds for criminal or legal action. Recent example was Harry Reed repeatedly saying, from the Senate floor, that Mitt Romney hadn't paid any taxes for years. Was a bald faced lie, Reed knew it, but he was very careful never to repeat it except when he was on the Senate floor. Besides, impeachment is a political, not a judicial, proceeding so I doubt that courts would want to intervene. This one in particular Roberts didn't even preside over so that leads me to believe that SCOTUS considered it to be a political show not a real impeachment trial.
