I'd say that's splitting hairs. The challenge (unless there's 2 cases) is that the SoS/Governor doesn't have the right to unilaterally change election laws or procedures. The constitution of the state of PA says it has to go thru the legislature.

The argument is that the result of those changes led directly to votes that were not cast according to the legislatively passed laws of the state of PA (i.e. illegal), and that illegally cast votes are tantamount to fraud.
