The Texas case was thrown out specifically because of "lack of standing".
There are two key pieces to note with this:
- This EXACT same thing happened in Pennslvania, where the Pennsylvania Supreme Court threw out the GOP's case because the election had not yet been certified. Similarly, the US Presidential election has NOT happened yet, because that ONLY occurs when the Electoral College meets. Everything up until that point is still only a state matter.
tl;dr: has Pennsylvania sent their electors to vote in the electoral college yet? No? Then nobody has been injured... yet.
- The MERITS (i.e. evidence) presented in this case was not ruled upon at all. ALL of this can be used with other cases.
As Rudy Guiliani stated tonight: they can simply copy/paste this entire lawsuit and replace Texas et al with the various legislatures in the affected states, who DO have standing. And they can do that as early as TONIGHT.
What DID happen with this case is a bunch of compromised AGs and Governors have scrambled and extended olive branches looking for a pardon.
