Frankly, the “unprovable “argument was the weakest of all the arguments presented to Judge Sullivan.

Sidney Powell gave the best reasons, namely that both of Flynn's guilty pleas were invalid.

The first: because the first judge was a friend of Peter Strzok and finally recused himself (the which Judge Sullivan was never curious about - never asked why he recused) and, the second: because

  1. Flynn was under “intractably” conflicted counsel (Covington and Burling - Eric Holder’s firm), and
  2. Judge Sullivan ‘surprised’ (I suspect Sullivan colluded via proxy with Covington and Burling to surprise) Flynn with an option to change his plea, even get a second opinion. But, he trusted his lawyers, who strongly encouraged him to take any plea deal they cleave him.

Speaking of colluding: Sullivan asked Gleeson if they had ever talked about the case (prior to Sullivan’s (illegal) appointment. Powell should ask if a third party proxied communications prior to his appointment.

Sydney Powell clearly laid out that Flynn's guilty pleas were null and void based on:

  • the recusal of the previous judge, and
  • the second for several reasons, most especially due to Flynn's counsel (the treacherous law firm where Eric Holder is a member).
