This reminds me of the song "blurred lines" by Robin Thicke. The music of the song was stolen from Marvin Gaye's song "Got to give it up." The Gaye estate sued way after they knew that Thicke and company stole the music from that song. The reason was to maximize the amount of profit from the song for a higher judgment or settlement. The estate ended up with a $5 million judgment. The fact that the judge throw out the case base on time is complete bias and not on law. If a law is unconstitutional, it is still unconstitutional no matter how long it takes to sue.
