Imagine if I put the condition in my TOS that, at my determination, I can enslave anyone who signs up for a period of three years to work without pay. It's black and white and it's in the TOS, but it doesn't magically become legal. It's a common, but very silly, misunderstanding of the law.
There was a case in CA that ruled that restaurants could open for outdoor dining. Higher court crushed in a few days, no reason given that I've heard... they just said "NO" and that was it.
