The CSIs are going to have a lot of fun figuring this one out. I do hope the photos are seen by the right eyes looking into this incident. He clearly has a grip on something, apparently a handgun, in the second photo. In the first, if you look closely, there are pixels in the web of his right hand that suggest he may have been holding something, but it's less clear.
